1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you”) and Creatizo Media Holdings Limited (“FrontDesk.ie,” “we,” “us”), a company registered in Ireland (CRO: 798461), trading as FrontDesk.ie.

By subscribing to or using our managed AI front desk service (“Services”), you agree to be bound by these Terms.

2. Service Description

FrontDesk.ie provides a managed AI front desk service for salons, barbers, and beauty professionals. This includes:

AI-powered conversation handling on WhatsApp, Instagram, Facebook Messenger, and website chat

Appointment booking facilitation through your existing booking platform

Automated follow-up messages to unbooked enquiries

Voice note and image understanding

Human handoff for complex or sensitive requests

Ongoing management and optimisation by Denis Colli

2.1 Managed Service

FrontDesk.ie is a managed service, not self-serve software. We set up, train, and manage your AI agent on your behalf.

2.2 AI Services

Our AI services process conversations in real-time, do NOT use your data to train foundation models, may occasionally produce inaccurate responses, and include AI disclosure in every agent’s opening message.

2.3 Service Changes

We may update or modify features to improve functionality, security, or compliance. Material changes to core functionality will be notified at least 14 days in advance.

3. Subscription Plans and Pricing

3.2 Founding 20

The first 20 clients receive their subscription rate locked for life.

3.3 Add-Ons

Reactivation Campaign: €99 per campaign (Growth clients from Day 45+; included for Scale)

3.4 Payment Terms

Monthly subscriptions paid in advance via Stripe

Annual subscriptions paid upfront (12 months + 3 bonus months)

Failed payments: 7 days to resolve before service suspension

3.5 Price Changes

Standard prices may change with 60 days’ written notice

Founding 20 clients are exempt from all price increases

4.2 30-Day Money-Back Guarantee

Full refund within 14 business days. No questions asked.

4.3 Refunds After 30 Days

Monthly: No refunds for partial months. Service continues until end of billing cycle.

Annual: Pro-rata refund at our discretion.

5. Your Responsibilities

5.1 Accurate Information

Provide accurate information about your salon. Inaccurate information may cause incorrect AI responses.

5.2 Booking Platform

Maintain your own booking platform and ensure booking links are active and current.

5.3 Acceptable Use

You agree NOT to:

Use Services for illegal activities

Send spam or unsolicited bulk messages

Use the AI to harass, deceive, or mislead

Violate WhatsApp, Instagram, or Facebook’s terms

Attempt to reverse-engineer our AI configurations

Resell or redistribute the Services without consent

5.4 Client Communication

You are responsible for handling complex requests escalated via human handoff.

6. Our Responsibilities

6.1 Service Delivery

AI agent setup within 48 hours of demo call and payment

Training on your salon’s services, pricing, hours, and tone

Ongoing monitoring and optimisation

Support response within 24 hours on business days

6.2 Availability

Target 99% uptime

Pro-rata credit for extended downtime (24+ hours) within our control

6.3 Data Protection

GDPR-compliant processing per our Privacy Policy

Data breach notification within 72 hours

7. Intellectual Property

7.1 Our Property

FrontDesk.ie brand, AI configurations, workflows, website content, and methodologies.

7.2 Your Property

Your salon’s brand, client data, conversation histories, and business information.

7.3 License

Non-exclusive, non-transferable, revocable license for the duration of your subscription.

8. Limitation of Liability

8.1 Service Limitations

AI responses may occasionally be inaccurate. We do not guarantee specific business results. Third-party platform outages are beyond our control.

8.2 Liability Cap

Maximum aggregate liability: total amount paid in the 12 months preceding the claim, up to €5,000.

8.3 Excluded Damages

We are not liable for indirect, incidental, special, or consequential damages, lost profits, or damages from AI-generated content.

8.4 Statutory Rights

This does not affect your rights under GDPR, the EU AI Act, or Irish consumer protection law.

9. Cancellation and Termination

9.1 Cancellation by You

Cancel anytime via WhatsApp or email

No minimum contract term (monthly subscriptions)

Service continues until end of current billing period

9.2 Termination by Us

Immediate termination if you fail to pay after 14 days’ notice, materially breach these Terms, or use Services for illegal activities.

9.3 Effect of Termination

AI agent deactivated within 24 hours

Data available for export for 30 days

After 30 days, data deleted per Privacy Policy

10. GDPR and Data Protection

10.2 Data Processing Agreement

These Terms and our Privacy Policy constitute a DPA under GDPR Article 28. A formal standalone DPA is available upon request.

10.3 STOP and Opt-Out Requests

We honour STOP requests immediately across all connected channels. Contacts are permanently excluded from future automated messages.

For WhatsApp marketing specifically, our system requires a valid consent basis before any marketing message is sent to your clients. Where consent has not been confirmed, contacts are automatically suppressed and cannot receive WhatsApp marketing messages.

10.4 Sub-Processor Changes

We will notify you in advance of material sub-processor changes. You may object and terminate without penalty if we cannot accommodate your objection.

11. Dispute Resolution

11.1 Informal Resolution

Contact Denis directly via WhatsApp or [email protected]. We aim to resolve issues within 14 days.

11.2 Governing Law

These Terms are governed by Irish law.

11.3 Jurisdiction

The courts of Ireland have exclusive jurisdiction, subject to your EU/EEA consumer protection rights.

12. General Provisions

12.1 Entire Agreement

These Terms, our Privacy Policy, and plan-specific terms constitute the complete agreement.

12.2 Amendments

Modified with 30 days’ written notice via email. You may cancel before new terms take effect.

12.3 Severability

Unenforceable provisions will be modified to the minimum extent necessary.

12.4 Force Majeure

Neither party is liable for delays caused by events beyond reasonable control.
